2013 US-China Legal Exchange

During the 18th U.S.-China Legal Exchange, senior Chinese government officials will present to public audiences in Washington, DC (Dec. 4), Boston, MA (Dec. 6), and Orange County, CA (Dec. 9) on recent developments in China's legal regimes governing (i) energy conservation and renewable energy, and (ii) entrepreneurship, including private equity and venture capital.

Background

Under the U.S.-China Joint Commission on Commerce and Trade (JCCT) Commercial Law Working Group, the U.S. Department of Commerce, Office of General Counsel leads engagement with China’s Ministry of Commerce (MOFCOM) to promote understanding and cooperation on issues related to commercial rule of law. Since the mid-1980’s, the Commerce General Counsel and China’s Vice Minister of Commerce have co-led the U.S.-China Legal Exchange, a public exchange on recent developments in commercial law. This meeting has taken place almost every year since then and continues to be an important means to build bilateral understanding of legal topics relevant to business in each country.

2013 Legal Exchange

During the 18th U.S.-China Legal Exchange, senior Chinese government officials will present to public audiences in Washington, DC (Dec. 4), Boston, MA (Dec. 6), and Orange County, CA (Dec. 9) on recent developments in China’s legal regimes governing (i) energy conservation and renewable energy, and (ii) entrepreneurship, including private equity and venture capital.

Assistant Minister of Commerce Zhang Xiangchen will lead China’s delegation. On the topic of energy, Mr. Cao Bingbing, Director of the Legislative Affairs Commission of the Standing Committee of the National People’s Congress, will present on China’s Renewable Energy Law; Mr. An Ning, Deputy Director of the Legislative Affairs Office of the State Council, will present on China’s Energy Conservation Law. On entrepreneurship, Mr. Wang Jun, Director at the Ministry of Commerce, will discuss China’s administration of foreign-invested venture capital and equity investment enterprises, and policy and prospects for the development of venture capital and equity investment.

The Commerce Department’s Acting General Counsel will lead on the U.S. side. During each portion of the program, U.S. experts on each topic will provide a response to the Chinese presentations and moderate a Q&A session with the audience.

Audience members, including representatives of the U.S. and Chinese business, legal, academic, communities and the public sector, will have an opportunity to engage with U.S. and Chinese Government officials, expert speakers and panelists, and other participants at various points throughout the program. Participating in the U.S.-China Legal Exchange would be beneficial for anyone interested in commercial law in China, and its potential impact on commercial activity.
